Approximately 70% of radiologists will face a malpractice claim during their career and more than 50% will be sued at least once by age 60. 80% of these claims involve misinterpretation of clinical tests and failure to diagnose. Frequently the delay in diagnosis results in delay in treatment of progressive diseases, such as cancer, and the potential monetary exposure can be very high. The many unique issues with respect to radiology claims, and teleradiology, will be addressed by the panel, including best practices/strategies to mitigate exposure and manage risk with examples given.

    7/10/2019 12:00 AM

Topic: This panel will demystify the concepts of telemedicine, telehealth, eHealth, and mHealth to discuss how technology is transforming the healthcare delivery and medical liability and insurance systems. Our panelists, who hail from legal academia and defense practice and insurance claims and underwriting, will discuss the trends, benefits, and risks of high-tech healthcare. We will tackle issues such as whether interactions between healthcare providers and e-health users create a doctor-patient relationship, whether mHealth apps are medical devices or products, the benefits and risks of electronic data aggregation and whether data security risks are covered in professional liability policies, how to handle choice-of-law and venue selection in cross-border telemedicine, and more. We will look at case studies and policy language to dissect some of these issues on the ground level. Additionally, since our medical liability and insurance systems are constantly evolving to accommodate technology growth, we would also like to introduce all participants to a legal design thinking exercise as a take home tool for discovering new approaches and solutions to the challenges that eHealth and telemedicine inject into medical malpractice claims and litigation. • Panel Discussion: Telemedicine – the Cryptocurrency of Professional Liability: Trends, Benefits, and Risks
